DHS Delays International Entrepreneur Rule “Start-up Visa”

The Department of Homeland Security delayed the effective date of the International Entrepreneur Rule to March 14, 2018. The rule was scheduled to go into effect on July 17, 2017. The Department explained in its published announcement that the delay would allow it to further consider the rule and will also issue a Notice of Proposed Rulemaking to receive public comment regarding the proposal to rescind the rule pursuant to a previous Executive Order.


It is expected that the Administration will ultimately rescind the rule which would have allowed foreign entrepreneurs to come to the United States to form a start-up, with requirements for a minimum investment amount and job creation.


The proposal to rescind the rule has been met with a backlash from the business community and technology industry, but it is too early to know if it will have an impact on the final decision by the Administration.
